Terms & Conditions

Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

Cooling-off period: the period during which the consumer may exercise their right of withdrawal.

Consumer: the natural person who is not acting for purposes related to a trade, business, or profession and enters into a distance agreement with the entrepreneur.

Day: calendar day.

Extended transaction: a distance agreement relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.

Durable medium: any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.

Right of withdrawal: the possibility for the consumer to withdraw from the distance agreement within the cooling-off period.

Entrepreneur: the natural or legal person offering products and/or services remotely to consumers.

Distance agreement: an agreement concluded between the entrepreneur and consumer within an organized system for distance selling, using one or more means of remote communication.

Means of remote communication: any method that can be used to conclude an agreement without the consumer and entrepreneur being physically present together.

Terms & Conditions: the present Terms & Conditions of the entrepreneur.

Article 3 – Applicability

These Terms & Conditions apply to every offer made by the entrepreneur and to every distance agreement and order concluded between the entrepreneur and the consumer.

Before the distance agreement is concluded, the text of these Terms & Conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed where the Terms & Conditions can be inspected and that they will be sent free of charge upon request.

If the agreement is concluded electronically, the Terms & Conditions may be provided electronically in a manner that allows the consumer to store them on a durable medium.

If one or more provisions of these Terms & Conditions are deemed invalid or void, the remaining provisions shall remain fully applicable.

Situations not covered by these Terms & Conditions shall be assessed in accordance with the spirit of these Terms & Conditions.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

All offers are non-binding. Virelitho reserves the right to modify and adjust offers.

Product descriptions are as accurate and complete as reasonably possible. Images are intended as a truthful representation of the products; however, colors displayed may differ slightly from actual product colors.

Obvious mistakes or errors in the offer do not bind the entrepreneur.

Each offer clearly states:

  • Product price

  • Shipping costs (if applicable)

  • Payment methods

  • Delivery methods

  • Applicability of the right of withdrawal

  • Validity period of the offer

  • Any applicable terms or restrictions

Import duties, customs fees, and VAT charged upon importation are the responsibility of the customer.


Article 5 – The Agreement

The agreement is concluded once the consumer accepts the offer and complies with the stated conditions.

If the agreement is concluded electronically, Virelitho will promptly confirm receipt electronically.

Virelitho reserves the right to refuse orders or impose additional conditions if there are valid reasons to do so.

All agreements are subject to product availability.


Article 6 – Right of Withdrawal

Consumers have the right to withdraw from the agreement within 14 days without giving any reason.

The withdrawal period begins on the day after the consumer, or a designated representative, receives the product.

During the cooling-off period, the consumer must handle the product and packaging with care.

To exercise the right of withdrawal, the consumer must notify Virelitho in writing or by email within 14 days after receiving the product.

The product must then be returned within 14 days after notification.

Proof of timely return shipment may be requested.


Article 7 – Costs in Case of Withdrawal

Return shipping costs are the responsibility of the consumer.

Refunds will be issued within 14 days after the returned product has been received and inspected, or after valid proof of return shipment has been provided.


Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products:

  • Made according to consumer specifications

  • Clearly personal in nature

  • That cannot be returned due to hygiene reasons

  • That deteriorate or expire quickly

  • Subject to financial market fluctuations

  • Newspapers and magazines

  • Opened software, audio, or video recordings

  • Sealed hygiene products once opened

The right of withdrawal may also be excluded for certain services, including accommodations, transportation, leisure activities, and services started with the consumer’s consent before the withdrawal period expires.


Article 9 – Pricing

Prices stated during the validity period of the offer will not increase, except due to VAT changes or legal regulations.

Prices are subject to printing and typographical errors.

Import VAT and customs clearance fees may be charged separately by postal or courier services.


Article 10 – Conformity and Warranty

Virelitho guarantees that products and services comply with the agreement and reasonable standards of usability and quality.

Consumers must report defects or incorrectly delivered products within 14 days after delivery.

Warranty does not apply if:

  • Products were repaired or modified by the consumer or third parties

  • Products were improperly used or negligently handled

  • Damage results from external regulations or misuse

Normal wear and tear are excluded from warranty coverage.


Article 11 – Delivery and Execution

Virelitho will exercise the utmost care when processing and delivering orders.

Delivery will take place at the address provided by the consumer.

Orders will generally be processed within 30 days unless a longer delivery time has been agreed upon.

If delivery is delayed or impossible, the consumer will be informed promptly and may terminate the agreement free of charge.

Risk of loss or damage remains with Virelitho until delivery to the consumer.


Article 12 – Duration Transactions: Duration, Termination & Renewal

Consumers may terminate agreements for an indefinite period at any time, subject to a notice period of no more than one month.

Fixed-term agreements may not be automatically renewed for a fixed duration unless legally permitted.

After one year, consumers may terminate long-term agreements with a notice period of no more than one month.


Article 13 – Payment

Unless otherwise agreed, payment must be made within 7 working days after the cooling-off period begins.

Consumers must immediately report inaccuracies in payment details.

In case of non-payment, Virelitho may charge reasonable collection costs in accordance with the law.


Article 14 – Complaints Procedure

Complaints regarding the performance of the agreement must be submitted fully and clearly within 7 days after discovering the issue.

Complaints submitted to Virelitho will be answered within 14 days.

If a complaint requires more processing time, the consumer will receive confirmation and an estimated response timeframe.

Complaints do not suspend the entrepreneur’s obligations unless agreed otherwise in writing.

If a complaint is found justified, Virelitho will replace or repair the product free of charge where appropriate.


Article 15 – Disputes

All agreements between Virelitho and the consumer are exclusively governed by Dutch law, regardless of the consumer’s country of residence.
